Immediately after the Feast of All saints last past this deponent, John Cock a witness produced with this deponent and Thomas Newby the party producent travelling together from Thetford in Norfolk to Diss where they dwelt, and as they so travelled they went very near unto Richard Bawlye's house in Gissing, and were speaking of Bawly, whereupon one looking out of the house, it being in the dark night, did speak to Newby who as this deponent verily believeth was the said Bawly and his reason is that although he did not see Bawly, yet he is so well acquainted with him and his speech as he is very well assured that it was he, and Bawly seeming displeased at some speeches uttered of him by Thomas Newby, amongst other words spoken by Bawly he speaking to Newby, You are drunk you, you, with some other like words which words were spoken in the parish of Gissing in the hearing of this deponent and the said John Cock… [This deponent is worth £100]… He doth very well know Thomas Newby of Diss, and saith that the words of defamation before by him deposed were spoken at the dark of night about seven of the clock… Thomas Newby is accounted a great company keeper and doth often drink at alehouses and saith that immediately before the speaking of the words before by him deposed of Thomas Newby and this deponent, and John Cock the elder a witness produced had been drinking at Tivetshall about an hour, but say that at the time of uttering the words of defamation by him deposed many ill words passed between the parties… He hath known Elizabeth Burdett the space of two years last past.
Soon after the feast of All Saints last past 1629, this deponent and John Cock a witness produced with him in this cause and Thomas Newby the party producent having had some business at Tivetshall in Norfolk were travelling together from thence to Diss where they dwelt, and upon the way they went through Gissing close by Richard Bawlye's house and being near his house they were talking of him and Newby complained That Bawly had done him some wrong by suits, whereupon one looking out at the door whom as this deponent doth confidently believe was Bawly, for he saw him not and seeming angered at some what [illegible] speech he overheard spoken by Newby, he so looking out said to Newby thus, vizt., You are drunk, you, with some other the like words which were spoken in Gissing in the hearing of this deponent and the said John Cock… The words before by him deposed of were spoken by 8 of the clock in the dark evening… Thomas Newby doth use to drink at alehouses and at the time of speaking the words before by him deposed of, Newby and this deponent and John Cock the younger had been drinking at a private house in Tivetshall about an hour… He knoweth Elizabeth Burdett about a year or two last past.
