Abstract

Catherine and Robinson Carter and John Hutchinson (the plaintiffs) cited James Dent and John Robson to exhibit and take on probate of the will of Jackson Sanderson, or to allow them to take on administration of his estate. Dent and Robson exhibited a will dated 11.11.1852 and argued that this was valid. They brought witnesses who confirmed that this will was executed in a proper manner. The plaintiffs countered by stating that whilst Sanderson had made a valid will on 9.11.1852, the will of 11.11.1852 had been drawn up on the instructions of one Esther Barker, the testator’s housekeeper, who was angry at being left out of the previous will. They alleged that Barker exercised an improper degree of control over Sanderson (he being afraid of her). They further claimed that on 11.11.1852 Sanderson had been insensible through illness, and was not conscious of executing the said will. The plaintiffs brought witnesses who supported these allegations. The court found for the plaintiffs, confirming the validity of the will of 9.11.1852 and rejecting that of 11.11.1852.
