Abstract

Holmes and Lister argued that probate of a will (dated August 1844) of James Rushforth, granted to Backhouse and Smallwood, ought to be revoked. They also attempted to prove the validity of a different will (dated November 1843) in which they were named as executors. Backhouse and Smallwood exhibited the will of August 1844 and alleged that this was valid, thereby arguing that the probate granted to them should not be reversed. They brought witnesses who confirmed that this will had been executed properly. Holmes and Lister countered by alleging that the will of 1844 had been ordered by Rushforth’s sons and not by him; that he was ‘debilitated in body and mind’ at the time of executing it and indeed mentally incapable of making a will, and that it had been made under threats from members of his family. They brought witnesses who supported these claims. Backhouse and Smallwood issued a replicatory application which denied that Rushforth had been of unsound mind, stating that at the time of making the will of 1844 he had been able to transact business and receive rents. They brought witnesses who confirmed this. Backhouse and Smallwood also issued an exceptive allegation in which they stated that William Sinclair, a prosecution witness, had confessed that he had made an error in his testimony. The court found for Holmes and Lister.
