Abstract

Ralph Worsley and Baldwin Wake attempted to prove the validity of the will of Frances Worsley, citing William, Thomas, Marcus, Frederick, Henry, Septimus, Charles, Arthur, Anne and Edmund Worsley, Isabella Blackden and Philadelphia Coltman and Frances Webber as defendants. The plaintiffs brought witnesses who confirmed that the will had been properly executed. William Worsley countered by alleging that Frances Worsley’s brother had been a lunatic and that she exhibited the same ‘mental weakness’, which rendered her incapable of disposing of her property and made liable to be unduly influenced by interested parties. He further gave additional particulars as to Frances Worsley’s incapacity. The case refers to family disputes regarding the treatment of Frances Worsley’s brother. William Worsley claimed that Ralph Worsley and one Matthew Phillips had taken advantage of this dispute and the testator’s weak mind to obtain money and to alienate her natural affection for him. He brought witnesses whose testimony supported his claims.In a long counter allegation, the plaintiffs denied that Frances Worsley had been of unsound mind or easily imposed upon. They stated that she had transacted business and had been considered capable of doing so, exhibiting letters to prove this. They also disputed many of William Worsley’s claims regarding family disputes, alleging that Frances Worsley had just cause to dislike him. The plaintiffs brought witnesses to support their arguments. William Worsley objected to the testimony of one William Rider, who had sworn that he did not unduly take advantage of the testator and considered her to be of sound mind. He brought witnesses who suggested that Rider had told them that he had obtained money from her and considered her will to be that of a ‘maniac’. The court found for Worsley and Wake (the plaintiffs), thereby confirming the validity of the will and hence decreeing that Frances Worsley had been of sound mind.
