Abstract

John and Samuel Atkinson had presented Samuel West for obstructing collection of tithes to which they claimed they were entitled under the terms of a ‘Contract or Covenant’ confirming them as farmers of the corn tithe ‘in writeing under hand and seale for the yeare 1703’. West’s proctor argued that the plaintiffs were indeed farmers of the corn tithe but only for the year 1703 and not under any written contract or document, adding that West had only taken the ninth part which was his to retain, leaving the tenth part for collection by the Atkinsons or their deputies. In their response, John and Samuel conceded that the tithe had been laid out but claimed that ‘Samuel West by himself wife or servants did by force of armes lett and hinder these r[esp]ond[en]ts or their serv[an]ts from takeing and carrying away the same’. Only the defence proctor’s statement and the plaintiff’s response survive for this cause.
